Apple vs. Samsung Trail: Judge Turns down Censure Appeal

In the ongoing Apple and Samsung trial, the judge has turned down Apple's appeal that Samsung be censured for releasing evidence.

Judge Lucy Koh, who is the presiding judge, came down scathingly on Samsung, but after interviewing jury members individually to see if they were affected by the leak, she declined to act further.

"Those remedies are not warranted by the current record," San Jose Mercury News reported her as saying. "I will not let any theatrics or sideshow distract us from what we are here to do."

The jurors confessed they had seen the reports. They were asked by Koh to refrain from reading them, while she promised they will all be given a scrapbook of the coverage when the trail ends.

Phil Schiller, Apple's marketing boss took to the stand defending his company's stance to own the round cornered design features for tablets. He said that Apple, since 2008 had spent $647 million for iPhone advertising globally and $457m for iPad.

"I was pretty shocked at the appearance of the Galaxy S phone and the extent to which it copied (Apple products)," Schiller said. "I absolutely believe it's had an impact on our sales."

Research conducted by Apple showed that iPhone users were likely to buy other Apple hardware in future impacting its sales. Schiller said that the tablet sector was dying and Apple took a huge risk to introduce its iPad, with Samsung's Galaxy Tab 10.1 introduction, he was concerned that they will be copying his company's whole product line.

Scott Forstall, Apple's senior vice president of iOS was also brought to the stand. He explained the working of iPhone engineers, who were recruited under strict terms of secrecy. They were even isolated from the rest in the Apple campus so that the news won't be leaked out. Even their doors had a sign saying "Fight Club" indicating silence was to be maintained. He did admit that Apple took phones from the competition to analyse them chiefly to sort out the antenna design problem and to avoid dropped calls.
