An injunction barring Samsung from continuing sales of its Galaxy Tab is set to go into effect after a judge ruled that Samsung violated Apple's design patent for its iPad.
The injunction comes after Apple had appealed the findings of Judge Lucy Koh, who had initially denied the injunction, despite determining that the the Galaxy Tab did infringe on Apple's patent, noting "Samsung appears to have created a design that is likely to deceive an ordinary observer."
Initially filed almost a year ago, the injunction is set to go into effect as soon as Apple posts a $2.6 million bond to the court.
Despite the injunction, Samsung was afforded a bit of wiggle room. They will be able to offer a tablet, provided it is re-designed and does not infringe on the iPad's design. Koh noted that "there was some evidence that Samsung altered its design to make its product look more like Apple's." Samsung's own attorney was unable to tell the difference between the iPad and Galaxy Tab at about 10 feet, supporting Apple's claim that Samsung was a "copycat." A representative for Apple has recently said, "Nanny nanny boo boo, stick your samsung in doo doo." Not really, but haters still gonna hate.
Apple and Samsung will be heading back to the courtroom soon enough, as they have over 20 lawsuits still pending. Koh is expected to make a ruling on another injunction, this time against Samsung's Galaxy Nexus.
